1. Who We Are
Shivasam Visuals is an AI-native film studio based in Thane, Maharashtra, India. We create advertisements, brand films, reels, music videos, VFX, event and wedding cinematics, and original films and series, including the feature film Fault Lines. This policy explains what personal data we collect through our Website, forms and business activities, and how we use and protect it, in line with India's Digital Personal Data Protection Act, 2023 and other applicable law.
2. Information We Collect
- Contact and project forms: name, email, phone or WhatsApp number, company, city, website or social handle, project type, brief, budget, timeline, reference links and any other details you choose to give.
- Emails and WhatsApp messages: your email address or phone number and the content of your messages.
- Client and project materials: scripts, brand assets, photos, footage and recordings you share for a project.
- Likeness data: where a project uses a real person's face, body or voice, the images or recordings provided, collected only with that person's written consent.
- Business and partner information: details of distributors, exhibitors, media, collaborators and screening guests (name, organisation, contact details and correspondence).
- Usage data: basic technical information such as browser type, device and pages visited, which may be recorded by our web host or by embedded services.
We do not knowingly collect personal data from children under 18 through the Website. Child characters in our films are AI-generated.
3. How We Use Your Information
- To reply to enquiries and discuss potential projects, partnerships, screenings and media requests.
- To prepare quotes, proposals and agreements, and to deliver and invoice commissioned work.
- To produce the project you commissioned, including processing Client Materials and consented likeness data with AI tools.
- To manage the distribution, promotion and screening of our films.
- To keep business, tax and legal records, and to protect our rights.
- To improve our Website and services.
We process your data on the basis of the consent you give (for example, when you tick the consent box on our forms), to perform a contract with you, or where required by law. We do not sell your personal data, and we do not use it to train AI models.
4. How We Share Information
- Service providers: our web-hosting and email provider (which delivers website forms to our inbox), cloud-storage providers, and messaging services such as WhatsApp (Meta).
- AI and production tools: project materials may be processed by the AI generation, voice, music and editing tools we use to make your project, under their terms.
- Collaborators: trusted freelancers or partners working on your project, who are bound to keep it confidential.
- Distribution and media partners: only with your agreement, or where needed to carry out an agreement you are part of.
- Authorities: where required by law or to protect our legal rights.
Some of these providers store data on servers outside India. Where data is transferred abroad, we rely on providers with recognised security practices and transfer it only as permitted by Indian law.
5. Video Embeds, Maps and Cookies
Our Website does not use advertising or tracking cookies of its own. It stores a small setting in your browser's session storage so the intro animation plays only once per visit.
Videos are embedded from YouTube and load only when you press play; YouTube may then set cookies and collect data under Google's privacy policy. The map on our Contact page is provided by Google Maps, which may also collect data when it loads. Fonts are served by Google Fonts.
6. Data Retention
We keep enquiry data for up to 24 months after our last contact, unless it becomes part of a project. Project records are kept for as long as needed to deliver the project and to meet legal, tax and accounting obligations (generally up to 8 years). Consented likeness data is used only for the agreed project and is deleted or returned when that project ends, unless the person agrees otherwise.
7. Security
We take reasonable technical and organisational measures to protect your data, including access-controlled accounts and secure file-sharing. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data breach affects you, we will notify you and the authorities as required by law.
8. Your Rights
Subject to applicable law, you may:
- ask for a summary of the personal data we hold about you and how it is used;
- ask us to correct, complete, update or erase your data;
- withdraw your consent at any time (this does not affect processing already carried out);
- nominate another person to exercise your rights in the event of death or incapacity; and
- raise a grievance with us, and if unresolved, with the Data Protection Board of India.
